Terms of Service
Effective date: April 18, 2026
These Terms of Service (the “Terms”) govern your access to and use of vibedsgn.com and related services (the “Service”). By creating an account or using the Service you agree to these Terms. For how we handle your personal data, see our Privacy Policy.
1. Acceptance & Changes
In plain English: by using vibedsgn, you agree to these rules.
These Terms form a binding agreement between you and Jakub Kowalik, operating as Jakub Kowalik Graphic Designer, a Polish sole proprietor registered in CEIDG (NIP 7393959038, REGON 520088222, registered office at ul. Iwaszkiewicza 30 lok. 21, 10-089 Olsztyn, Poland) — referred to in these Terms as “vibedsgn”, “we”, or “us”.
By creating an account, posting content, or otherwise using the Service, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use the Service.
2. The Service
In plain English: vibedsgn is the community for vibe-coded design. Features may change.
vibedsgn is a community platform where registered users can post AI-generated UI projects (“vibes”) with screenshots and descriptions, follow other members, comment, like, compete on public leaderboards (“rank”), browse a tool directory, and read editorial articles. We may add, modify, or discontinue features at any time. We do not guarantee that the Service will be available without interruption.
3. Eligibility & Account
In plain English: you must be 16+, use real information, and keep your login safe.
- You must be at least 16 years old to create an account or use the Service.
- You must provide accurate information when you sign up and keep it current.
- You may only hold one personal account. Sockpuppet or secondary accounts used to manipulate engagement are not permitted.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us promptly of any unauthorised access at hello@vibedsgn.com.
4. Your Content
In plain English: your work stays yours.
You retain all ownership rights in the vibes, images, descriptions, comments, tool submissions, and any other content you post to the Service (“Your Content”). You are solely responsible for Your Content and for ensuring you have the rights to post it.
5. License You Grant to vibedsgn
In plain English: so we can actually run the site and show off your work, we need a limited license. We do NOT get to train AI on it.
By posting Your Content to the Service, you grant vibedsgn a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, cache, reproduce (including generating thumbnails, feed renderings, and Open Graph preview images), publicly display, distribute within the Service, and publicly perform Your Content solely for the purposes of operating, improving, and promoting the Service.
This license includes the right to feature Your Content — with attribution where reasonably practical — on the vibedsgn homepage, in the vibedsgn newsletter, and on vibedsgn’s official social media channels in order to showcase and promote the community.
This license does NOT grant vibedsgn the right to train, fine-tune, or otherwise use Your Content for machine-learning model training, and it does not grant the right to license Your Content to third parties for that purpose. See the AI Training Policy in our Privacy Policy.
The license ends when you delete Your Content or your account, except that (i) we may retain and use cached, backup, or aggregate copies for a reasonable transitional period, and (ii) any sublicenses already granted to other users to reference or share your posts within the Service may survive in their existing form.
6. License to Other Users
In plain English: other members can like, comment on, bookmark, and share your vibes through the site’s normal features.
By posting public content, you grant other users a limited, non-exclusive license to view Your Content and to interact with it through the native features of the Service (for example, liking, bookmarking, commenting, following, and sharing a link). This license does not authorise other users to copy, redistribute outside the Service, or create derivative works from Your Content except as expressly permitted by you.
7. Acceptable Use
In plain English: don’t be a jerk, don’t infringe other people’s rights, and don’t game the system.
You agree not to:
- Post content that infringes any third party’s intellectual property, privacy, or other rights.
- Post content that is unlawful, defamatory, harassing, hateful, threatening, sexually explicit, or that incites violence or discrimination.
- Send spam, bulk unsolicited messages, or commercial solicitations.
- Scrape, crawl, or use automated tools to access the Service without our prior written permission.
- Manipulate leaderboard rankings, including by self-voting with alternative accounts, bot voting, incentivised voting, or coordinated activity.
- Create sockpuppet or impersonation accounts.
- Upload malware, exploit code, or otherwise attempt to compromise the Service, its infrastructure, or its users.
- Reverse-engineer, decompile, or otherwise attempt to extract source code of the Service, except where such restriction is prohibited by applicable law.
- Circumvent authentication, rate limits, abuse controls, or any other security mechanism.
8. Leaderboard Integrity
In plain English: the rank page is what makes vibedsgn fun. Cheat and you’re out.
Votes, likes, and similar signals must reflect genuine interest by the user making them. Self-voting with alternative accounts, bot voting, paid-for-engagement schemes, and coordinated manipulation of any kind are prohibited and will result in removal of the affected content, forfeiture of ranking, and termination of the offending accounts.
9. Tool Directory
In plain English: the tools list is user-submitted. We don’t vouch for any of them.
The tool directorycontains listings submitted by users. vibedsgn does not endorse, verify, test, or guarantee the accuracy, availability, safety, or quality of any listed tool. Use listed tools at your own risk and under their respective providers’ terms.
10. Our Intellectual Property
In plain English: the vibedsgn brand, logo, codebase, and design are ours.
The Service, including the vibedsgn brand, logo, visual identity, source code, design system, and all related materials, is owned by vibedsgn and protected by Polish and international law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. No other rights are granted by implication.
11. Copyright & Takedown
In plain English: if someone posts your work without permission, email us and we’ll take it down.
If you believe content on the Service infringes your copyright or other rights, send a notice to hello@vibedsgn.com containing:
- Your full name and contact details.
- Identification of the work you claim has been infringed (for example a link to the original).
- A link to the specific content on vibedsgn that you consider infringing.
- A statement that you have a good-faith belief the use is not authorised by the rightsholder, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rightsholder or authorised to act on the rightsholder’s behalf.
- Your physical or electronic signature.
We will review each notice, remove or disable access to content that appears to infringe, and may terminate the accounts of repeat infringers. If you believe content was removed in error, you may submit a counter-notice using the same email address.
12. Third-Party Services
In plain English: we’re glued together with other people’s stuff. Their rules apply too.
The Service integrates with third-party providers including Google and GitHub (for OAuth sign-in), Resend (for email delivery), and Vercel (for hosting and file storage). Your use of those services through vibedsgn is also governed by their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.
13. Termination
In plain English: either of us can end this, and we can remove accounts that break the rules.
You may stop using the Service and delete your account at any time. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive or fraudulent behaviour, or put vibedsgn or its users at legal or security risk. Sections of these Terms that by their nature should survive termination (including Sections 4, 5, 10, 14, 15, 16, 17, 18, and 22) will survive.
14. Disclaimers
In plain English: we provide the service “as is” — subject to your non-waivable rights under Polish and EU consumer law.
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that content posted by users is accurate, reliable, or lawful.
Nothing in this Section limits your mandatory rights as a consumer under Polish or EU law (including under the Polish Act on Consumer Rights of 30 May 2014 and the Civil Code). Where you are a consumer, the statutory warranties that cannot be excluded continue to apply.
15. Limitation of Liability
In plain English: we cap our liability — but not for things the law says we can’t cap.
To the fullest extent permitted by applicable law, vibedsgn’s total aggregate liability to you arising out of or in connection with the Service or these Terms is limited to the greater of (i) the amounts you paid to vibedsgn in the twelve (12) months preceding the event giving rise to liability, or (ii) EUR 100.
vibedsgn will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for gross negligence, for wilful misconduct, for fraud, or for any other liability that cannot be excluded or limited under applicable law.
16. Indemnification
In plain English: if your content or behaviour gets us sued, you help cover it — within what the law allows.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless vibedsgn and its operator from and against any third-party claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of or related to (i) Your Content, (ii) your use of the Service in breach of these Terms, or (iii) your violation of any applicable law or third-party right.
17. Governing Law
In plain English: Polish law applies.
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Poland, without regard to conflict-of-laws principles and without prejudice to any mandatory protections available to you as a consumer in your country of habitual residence.
18. Dispute Resolution
In plain English: disputes go to Polish courts — but EU consumers can always sue in their home country.
Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the Polish courts competent for the registered office of Jakub Kowalik Graphic Designer (Olsztyn).
If you are a consumer domiciled in the European Union, nothing in this Section deprives you of the protection afforded by mandatory rules of the law of your country of residence, including the right, under Regulation (EU) 1215/2012 (“Brussels I Recast”), to bring proceedings in the courts of the Member State where you are domiciled and to defend proceedings brought against you only in those courts.
19. Consumer Rights
In plain English: vibedsgn is currently free. If we ever add paid services, EU consumer protections will apply.
vibedsgn does not currently charge fees for access to the Service. If we introduce paid features in the future, consumers domiciled in the EU will benefit from the rights granted under the Polish Act on Consumer Rights of 30 May 2014 and under EU consumer-protection directives, including, where applicable, the right to withdraw from a distance-concluded contract within 14 days.
20. Online Dispute Resolution (ODR) Platform
In plain English: the EU runs a website where consumers can start a dispute online. Here’s the link.
The European Commission provides an online dispute resolution platform accessible at ec.europa.eu/consumers/odr. We are not currently obliged to, and do not, commit to using alternative dispute resolution entities to resolve disputes with consumers.
21. Changes to These Terms
In plain English: if we change the rules, we’ll tell you. If you don’t like the change, delete your account.
We may modify these Terms from time to time. If we make material changes we will notify registered users by email and display a prominent notice in the Service at least 14 days before the change takes effect, unless an earlier change is required by law. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may delete your account.
22. Miscellaneous
In plain English: the usual clean-up clauses.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and vibedsgn regarding the Service.
- Assignment. You may not assign or transfer your rights under these Terms. vibedsgn may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
- Notices. Notices to vibedsgn should be sent to hello@vibedsgn.com or to the registered address above. Notices to you will be sent to the email address on your account or posted in the Service.
- Language. The English-language version of these Terms is the authoritative version; any translation is provided for convenience only.
